1. Overview and Acceptance

These Terms of Service (Terms) govern access to and use of the website located at https://get.rekt.com (the Platform), and participation in any promotional, experiential, or marketing activations that permit users to claim $REKT tokens using a unique code (each, an Activation).

By accessing the Platform, submitting a code, or claiming tokens, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must not use the Platform.

2. Platform Purpose

The Platform is a claims and redemption interface used to distribute $REKT tokens as part of brand marketing, promotional campaigns, and community engagement initiatives.

The Platform is not a marketplace, exchange, wallet provider, financial service, or investment platform.

3. Activations and Offer Variability

All offers made available through the Platform form part of specific Activations.

Each Activation may vary, without limitation, with respect to:

• Eligibility requirements
• Token quantities
• Redemption limits
• Duration or expiration
• Geographic availability
• Distribution mechanics

All Activations are subject to change, suspension, or termination at any time, with or without notice. No representation is made that any Activation will continue for any particular period or be available in the future.

Participation in one Activation does not guarantee eligibility for any other Activation.

4. Eligibility

Unless otherwise required by applicable law, participants must:

• Be at least 18 years of age
• Have legal capacity to enter into binding agreements
• Not be located in a jurisdiction where participation is prohibited
• Not be subject to economic or trade sanctions

Participation is void where prohibited. The Platform may restrict or deny access based on jurisdiction, IP address, wallet activity, or other compliance or risk indicators.

5. Geographic and Regulatory Limitations

Participation is not available in jurisdictions subject to economic or trade sanctions, or where the distribution of digital tokens is restricted or prohibited by law.

Nothing on the Platform constitutes:

• An offer or sale of securities
• An offer to the public of crypto-assets under EU or UK financial services law
• Financial, investment, legal, or tax advice

Users are solely responsible for determining whether participation is lawful in their jurisdiction.

Rekt Brands Inc does not issue, control, manage, or guarantee the availability, price, liquidity, or secondary market trading of $REKT tokens.

7. About $REKT Tokens

$REKT is a digital promotional token, commonly referred to as a memecoin, distributed solely as part of marketing and community engagement initiatives.

$REKT:

• Has no intrinsic value
• Is not intended as an investment, store of value, or medium of exchange
• Does not confer ownership, equity, voting rights, or claims on assets
• Has no guaranteed liquidity, price stability, or exchange availability

No representations are made regarding current or future value, utility, listings, or market behavior. Users should not expect profit or appreciation.

For users in the United Kingdom, $REKT is not intended to be a financial promotion and should be regarded solely as a promotional digital item.

8. Token Custody and User Responsibility

Users are solely responsible for:

• Selecting and maintaining a compatible crypto wallet
• Safeguarding private keys, recovery phrases, and credentials
• Ensuring correct wallet addresses are used

Neither Rekt Brands Inc nor Golden Pothos Foundation provides custody services and shall not be responsible for:

• Lost, stolen, inaccessible, or irretrievable tokens
• Wallet errors or incompatibilities
• Blockchain failures, congestion, forks, or network issues
• Third-party wallet providers, infrastructure, or services

Once tokens are distributed, they are outside the control of the Platform.

9. Code Distribution and Redemption

Users may receive a unique alphanumeric code through various channels, including but not limited to retail purchases, events, digital campaigns, or promotional giveaways.

Codes:

• Have no cash value
• Are non-replaceable
• May expire or become invalid
• May be limited to one-time or capped use

Redemption is subject to availability and technical constraints. Lost, damaged, expired, or unused codes will not be replaced.

10. No-Purchase Entry

Where required or permitted by applicable law, a no-purchase method of participation may be available.

If you wish to participate via a no-purchase entry method, and such participation is permitted in your jurisdiction, please contact hello@rekt.com with your request. Availability, eligibility, and fulfillment of no-purchase entries are subject to verification and may be limited or denied at the Platform's discretion.

11. Fraud, Abuse, and Prohibited Conduct

Prohibited conduct includes, without limitation:

• Use of bots, scripts, or automated systems
• Wallet farming, Sybil behavior, or coordinated abuse
• Circumventing redemption limits or safeguards
• Resale, transfer, or aggregation of codes
• Any attempt to manipulate, exploit, or interfere with the Platform

The Platform reserves the right to void claims, block wallets or IP addresses, suspend access, or terminate participation without notice.

12. Price Volatility and Market Risk

Digital tokens may be subject to extreme price volatility or complete loss of value.

The Platform makes no representations regarding:

• Market price
• Liquidity
• Exchange availability
• Ongoing functionality or usability

Users assume all risks associated with holding, transferring, or interacting with $REKT.

13. Taxes

Users are solely responsible for any tax obligations arising from the receipt, ownership, or use of tokens. No tax advice is provided.

14. Modification, Suspension, and Termination

The Platform, these Terms, and any Activation may be modified, suspended, or terminated at any time, for any reason, without notice.

Continued use of the Platform constitutes acceptance of any updated Terms.

15. Disclaimer of Warranties

The Platform and tokens are provided on an "as is" and "as available" basis.

All warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, are disclaimed to the maximum extent permitted by law.

16. Limitation of Liability

To the maximum extent permitted by law, neither Rekt Brands Inc nor Golden Pothos Foundation shall be liable for any indirect, incidental, consequential, punitive, or speculative damages arising from use of the Platform, participation in any Activation, or receipt or use of tokens.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.

Any dispute shall be resolved by binding arbitration, except that the Platform reserves the right to seek injunctive or equitable relief for misuse, fraud, or intellectual property violations.
