REKT Terms of Service

1. Overview and Acceptance

These Terms govern the website at https://get.rekt.com (the "Platform") and participation in promotional activations where users claim $REKT tokens using unique codes ("Activations"). By accessing the Platform or claiming tokens, you agree to be bound by these Terms in full.

2. Platform Purpose

The Platform distributes $REKT tokens through brand marketing and community engagement. The Platform is not a marketplace, exchange, wallet provider, financial service, or investment platform.

3. Activations and Offer Variability

Each Activation may vary regarding eligibility, token quantities, redemption limits, duration, geographic availability, and distribution mechanics. All Activations are subject to change, suspension, or termination at any time, with or without notice. Participation in one Activation does not guarantee eligibility for others.

4. Eligibility

Participants must:

• Be at least 18 years old
• Have legal capacity to enter agreements
• Not be located in a prohibited jurisdiction
• Not be subject to economic or trade sanctions

The Platform may restrict access based on jurisdiction, IP address, wallet activity, or compliance indicators.

5. Geographic and Regulatory Limitations

Participation is unavailable in sanctioned jurisdictions or where token distribution is prohibited by applicable law. The Platform does not constitute an offer or sale of securities or financial advice. Users are solely responsible for determining the legality of participation in their jurisdiction.

6. Sponsors and Responsible Entities

Token Issuance: Golden Pothos Foundation, Grand Cayman, Cayman Islands

Rekt Brands Inc does not issue, control, manage, or guarantee token availability, price, liquidity, or secondary market trading.

7. About $REKT Tokens

$REKT is a digital promotional memecoin with no intrinsic value and is not intended as an investment, store of value, or medium of exchange. It does not confer ownership, equity, voting rights, or claims on any assets. No representations are made regarding current or future value, utility, or market behavior. Users should not expect profit or appreciation. For UK users, $REKT is solely a promotional digital item.

8. Token Custody and User Responsibility

Users must select and maintain compatible wallets, safeguard credentials, and ensure correct addresses. Neither company provides custody services and neither is responsible for lost tokens, wallet errors, blockchain issues, or third-party infrastructure failures. Once tokens are distributed, they are outside the control of the Platform.

9. Code Distribution and Redemption

Unique codes may come through retail purchases, events, campaigns, or giveaways. Codes have no cash value, are non-replaceable, may expire, and may be limited to one-time use. Lost, damaged, expired, or unused codes will not be replaced.

10. No-Purchase Entry

Where permitted by law, no-purchase participation methods may be available. Interested parties should contact hello@rekt.com. Availability and fulfillment are subject to verification and may be limited or denied at the Platform's discretion.

11. Fraud, Abuse, and Prohibited Conduct

Prohibited activities include:

• Using bots or automated systems
• Wallet farming or Sybil behavior
• Circumventing limits
• Reselling codes
• Attempting to manipulate the Platform

The Platform reserves the right to void claims, block wallets or IP addresses, and suspend access without notice.

12. Price Volatility and Market Risk

Digital tokens are subject to extreme volatility or complete value loss. The Platform makes no representations regarding market price, liquidity, exchange availability, or ongoing functionality. Users assume all risks.

13. Taxes

Users are solely responsible for all tax obligations arising from token receipt, ownership, or use. No tax advice is provided.

14. Modification, Suspension, and Termination

The Platform, these Terms, and any Activations may be modified, suspended, or terminated at any time for any reason without notice. Continued use constitutes acceptance of updated Terms.

15. Disclaimer of Warranties

The Platform and tokens are provided on an "as is" and "as available" basis. All warranties—express or implied—including merchantability and fitness for particular purposes, are disclaimed to the maximum extent permitted by law.

16. Limitation of Liability

To the maximum extent permitted by law, neither company is liable for indirect, incidental, consequential, punitive, or speculative damages arising from Platform use, Activation participation, or token receipt or use.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware. Disputes shall be resolved through binding arbitration, except the Platform may seek injunctive relief for misuse, fraud, or intellectual property violations.

1. Activation Overview

REKT Energy Powder products sold on Amazon.com include a physical insert card containing a unique alphanumeric code (the "Code"). Each Code entitles the holder to claim a specified quantity of $REKT tokens by entering the Code on the Platform at https://get.rekt.com (the "Energy Powder Activation").

2. Reward Amount and Adjustment

The initial Reward Amount for this Activation is 140,000,000 (one hundred forty million) $REKT tokens per Code (the "Reward Amount").

Right to Adjust: The Company reserves the sole and absolute right to increase, decrease, or otherwise modify the Reward Amount at any time, for any reason, with or without prior notice. Changes to the Reward Amount apply only to Codes redeemed after the effective date of the change. Codes already redeemed at a prior Reward Amount will not be affected retroactively.

By participating in this Activation, you acknowledge and agree that the Reward Amount is not fixed and may change over the course of the promotion. The Reward Amount displayed on the Platform at the time you enter your Code is the amount you will receive, regardless of any previously advertised amount.

3. Eligibility

In addition to the general eligibility requirements in Part A, participants in the Energy Powder Activation must:

• Have purchased a REKT Energy Powder product through Amazon.com (United States marketplace) or have obtained a valid Code through an authorized no-purchase method
• Be a resident of a non-restricted jurisdiction (see Section 4 below)
• Limit redemption to one Code per product unit purchased

Bulk purchasing of products solely for the purpose of accumulating Codes, or any commercial resale of Codes, is strictly prohibited and may result in voiding of all associated claims.

4. Geographic Restrictions and Geo-Blocking

This Activation is intended for participants in the United States. The Platform will implement IP-based geo-blocking to restrict access from certain jurisdictions due to applicable sanctions, crypto-asset prohibitions, or regulatory incompatibility.

The Platform may also restrict access from additional jurisdictions not listed above based on evolving regulatory guidance. Use of VPNs, proxies, or other tools to circumvent geographic restrictions is strictly prohibited and will result in the immediate voiding of any claims and permanent suspension of access.

5. Code Redemption Process

1. Locate the insert card inside your REKT Energy Powder product packaging.
2. Visit https://get.rekt.com and enter the unique Code from your insert card into the redemption field.
3. If the Code is valid and you meet all eligibility requirements, you will be redirected to the Base app where you can claim the applicable Reward Amount of $REKT tokens.

Each Code may only be redeemed once. Once a Code has been submitted, it cannot be reused, transferred, or reissued regardless of whether the redemption was successful. The Platform is not responsible for user error in entering Codes or wallet addresses.

6. No Cash Value

Codes and the $REKT tokens distributed through this Activation have no cash value and cannot be exchanged for cash, credit, or any other form of monetary compensation from the Company. The tokens are distributed solely as a promotional item.

7. Returns, Refunds, and Token Reclamation

Redemption of a Code constitutes use of the promotional component of the product. By redeeming a Code, the participant acknowledges that the product is considered opened and used, and may not be eligible for return or refund through Amazon or any other retail channel on the basis that the promotional benefit has been consumed.

Token Return Obligation: In any case where a return or refund of a Rekt Energy Powder product is accepted, whether by Amazon, the Company, or any authorized retailer—the participant is obligated to return the full Reward Amount of $REKT tokens claimed via the associated Code. The Company reserves the right to:

• Request the return of tokens to a designated wallet address within fourteen (14) days of the refund being processed
• Deduct or offset the equivalent token amount from any future claims or Activations associated with the participant's wallet address
• Suspend or permanently block the participant's wallet address and/or account from the Platform until the token return obligation is satisfied

Failure to return tokens following a product return constitutes a breach of these Terms and may result in legal action to recover the value of the unreturned tokens. The Company may, at its sole discretion, calculate the value of unreturned tokens based on the market price at the time of the original claim or the time of the return request, whichever is greater.

8. Expiration and Termination

The Company reserves the right to set expiration dates for Codes and to terminate the Energy Powder Activation at any time, with or without prior notice. Any unredeemed Codes at the time of termination will become void and no compensation will be provided.

9. Amazon Disclaimer

This Activation is organized and administered solely by Rekt Brands Inc. Amazon is not a sponsor, co-sponsor, or administrator of this Activation and is not responsible for any aspect of the token distribution, Code redemption, or related promotional activity. Any questions or issues related to this Activation should be directed to hello@rekt.com, not to Amazon.

10. Anti-Abuse Provisions

In addition to the general anti-abuse provisions in Part A, the following specific provisions apply to this Activation:

• Codes obtained through unauthorized channels, theft, or fraud are void
• The Company reserves the right to require proof of purchase before honoring any Code redemption
• Systematic or automated Code entry attempts will result in IP blocking and voiding of all associated claims
• The Company may implement rate limiting, CAPTCHA verification, or additional identity verification at its discretion
• Any attempt to reverse-engineer, brute-force, or predict Code sequences is prohibited and may result in legal action

11. Limitation of Liability Specific to Energy Powder Activation

Without limiting the general limitation of liability in Part A, the Company's total aggregate liability for all claims arising out of or related to the Energy Powder Activation shall not exceed the retail purchase price of one (1) REKT Energy Powder product unit on Amazon.com at the time of purchase.

12. Amendments to These Supplemental Terms

These Energy Powder Terms may be amended at any time by posting updated terms on the Platform. The "Effective Date" at the top of this document will be updated accordingly. Continued participation in the Energy Powder Activation after any amendment constitutes acceptance of the revised terms.

1. Activation Overview

This Activation ("Waitrose UK Activation") allows eligible participants to claim 55,000,000 (55 million) $REKT tokens per qualifying purchase of a Rekt Flavoured Sparkling Water 4-pack from participating Waitrose & Partners stores in the United Kingdom. Tokens are claimed by scanning or entering the unique code found on the sticker affixed to qualifying 4-pack products via https://get.rekt.com.

2. Eligibility

• Participants must be aged 18 or older and resident in the United Kingdom.
• Participants must have the legal capacity to agree to these Terms.
• Participants must not be subject to any applicable economic sanctions.
• This Activation is open to UK residents only. Participation from outside the UK using VPNs, proxies, or other means to circumvent geographic restrictions is prohibited and will result in permanent suspension from the Platform.

3. Qualifying Products

• Only Rekt Flavoured Sparkling Water 4-packs purchased from Waitrose & Partners stores in the United Kingdom (including online purchases via waitrose.com) that bear a valid promotional sticker are eligible.
• Not all 4-packs may carry promotional stickers. Only stickered packs qualify.

4. Reward Amount

• Each valid code entitles the participant to claim 55,000,000 (55 million) $REKT tokens.
• The Company reserves the sole and absolute right to increase, decrease, or otherwise modify the Reward Amount at any time, for any reason, without prior notice.

5. Availability & Duration

• This Activation runs while promotional stock lasts. Once all stickered 4-packs have been sold, no further codes will be available.
• There is no guaranteed end date. The Company may suspend or terminate this Activation at any time without notice.
• The Company does not guarantee stock availability at any particular Waitrose store.

6. Code Redemption

• Each code may be redeemed once only through https://get.rekt.com.
• Codes are non-transferable, have no cash value, and cannot be exchanged, sold, or replaced.
• Lost, stolen, or damaged codes will not be replaced.
• The Company is not responsible for codes that are illegible, damaged, or removed from packaging.

7. Token Return Obligation

If a qualifying product is returned to the retailer after a code has been redeemed, the participant must return the claimed $REKT tokens to the Company within 14 days of the product return. Failure to do so may result in:

• Suspension of the participant's wallet from the Platform.
• Recovery action at the Company's discretion.

8. Anti-Abuse Measures

• Codes obtained from unauthorised channels (including but not limited to secondary marketplaces, social media resale, or bulk purchasing for resale) are void.
• Automated or bot-driven redemption attempts will result in IP blocking and permanent suspension.
• Any attempt to reverse-engineer, duplicate, or fabricate codes may result in legal action.

9. Limitation of Liability

To the maximum extent permitted by applicable law (including but not limited to the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008):

• The Company's total liability in connection with this Activation shall not exceed the retail purchase price of one qualifying 4-pack product.
• The Company does not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
• Nothing in these Terms affects participants' statutory rights as consumers under English law.

10. Governing Law

These Activation Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction.

11. Data Protection

Personal data collected through this Activation will be processed in accordance with the Company's Privacy Policy and applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By participating, you acknowledge that your data may be transferred to and processed in the United States, subject to appropriate safeguards as required by applicable law.
